Willamette Valley Ornament Hunt Sweepstakes Rules

AGREEMENT TO OFFICIAL RULES
By participating, Entrants agree to abide by and be bound by these Official Rules and the decisions of the Sponsor, which are final and binding in all matters relating to the Sweepstakes. Winning the grand prize is contingent upon fulfilling all requirements set forth herein.

TERM
The "Willamette Valley Ornament Hunt" Sweepstakes begins November 17, 2023, and ends at 11:59 p.m. PST December 31, 2023. All entries must be made via entry on the official Sweepstakes page. Entries become the property of Sponsor.

WHO MAY ENTER
Sweepstakes is open only to legal residents of the United States (excluding residents of Puerto Rico), and Canada except where prohibited by law.  Employees of Sponsor, and its affiliates and subsidiaries, and their immediate family members (spouse, parent, sibling and their respective spouses, regardless of where they live) or persons living in the same households of such individuals, whether or not related, are not eligible to enter or win a prize. SWEEPSTAKES IS VOID OUTSIDE OF THE UNITED STATES AND CANADA AND WHERE PROHIBITED. Limited to one entry per household.

HOW TO ENTER
To enter the Willamette Valley Ornament Hunt, entrants must complete and submit the entry form on the sweepstakes page on willamettevalley.org/ornament before 11:59 p.m. PST December 31, 2023, that includes their ornament id, name, zip or postal code, email and agreement that they have read and understand the Official Rules and Privacy Policy.

Sweepstakes entry begins November 17, 2023 10:00 am PST and ends at 11:59 p.m. PST December 31, 2023 (Sweepstakes Period). The Sponsor interprets the official time keeping device for the Sweepstakes. 

Entrants who successfully enter the sweepstakes will see a confirmation message of a successful submission. The Sponsor is not responsible for early, late, incomplete, misdirected, or delayed entries. Incomplete information may result in disqualification of entry. Entries generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified. No mechanical reproductions or facsimiles of entries allowed. All entries become the exclusive property of Sponsor and will not be acknowledged or returned. 

Limit one entry per household. If more than one entry per household is represented, all entries from said household are void and all household registrants will be disqualified from the 2023 contest.

SWEEPSTAKES PRIZES
THE POTENTIAL WINNERS ARE REQUIRED TO EXECUTE ALL OR SOME OF THE FOLLOWING: (1) AN AFFIDAVIT OF ELIGIBILITY AND LIABILITY RELEASE; (2) WARRANTY OF OWNERSHIP AND LICENSE; (3) PUBLICITY RELEASE; AND (4) ANY OTHER AFFIDAVITS AND/OR RELEASES OR ADDITIONAL DOCUMENTS THAT MAY BE REQUIRED BY PRIZE SUPPLIER(S). UNLESS PROHIBITED BY LAW, THE POTENTIAL WINNER MUST SIGN THESE DOCUMENTS NO LATER THAN 30 DAYS FROM THE DATE OF PRIZE NOTIFICATION IN ORDER FOR SPONSOR TO AWARD THE PRIZE. NONCOMPLIANCE OR RETURN OF PRIZE NOTIFICATION AS UNDELIVERABLE MAY RESULT IN DISQUALIFICATION AND, AT SPONSORS DISCRETION, SELECTION OF AN ALTERNATE WINNER.  

One winner will be selected to win one Grand Prize. Dates are subject to the discretion of Sponsor. Prizes are subject to availability. Grand Prize is detailed below:  

A 2-night stay at the Holman Hotel in Salem, Oregon

An experience at Kitchen at Middleground farm for $400

Complimentary wine tasting at Björnson Vineyards

Heart of the Willamette Valley Wine Passport

$150 Visa Gift Certificate

Qualifications for the Grand Prize include one ornament and the successful submission of the Ornament ID into the registration form. Note that transportation costs will not be provided with any of the prizes. 

DRAWING AND NOTIFICATION
Prizes have been associated with random ornament tag I.D. numbers. Qualifications for the Grand Prize (see above details) are as follows: find one ornament and successfully enter the sweepstakes via the official Sweepstakes page and enter the correct randomized tag I.D. number within sweepstakes period. The winner will be notified via the Prize Administrator (The Willamette Valley Visitors Association) no later than January 15, 2024. The winner will be required to confirm prize no later than January 15, 2023 at 5:00 PST. If the winner does not confirm within this time period the prize will become null and void. 

GRAND PRIZE DETAILS

*Qualifications for this prize (Grand Prize) include finding an ornament and the successful submission of the Ornament ID into the registration form. 

If a winner is unable to travel during the prize period: May 1, 2024,  through November 30, 2024 (blackout dates apply), they must communicate with Administrator. This prize may be transferable with Administrator approval. If winner is a minor, winner will be required to travel with an adult over 21 years of age. Certain restrictions may apply. Winners will be responsible for all necessary travel authorizations and travel insurance. By accepting the prizes, Winner represents that they understand that travel, whether in developed or remote areas and whether by plane, automobile, rail, boat, raft, or other conveyance, or by foot, on land or water, and in the air, contains some inherent element of risk of accident, illness, injury, loss or death, which may be caused by negligence, forces of nature, wild animals or other agencies, known or unknown. Winner represents that they recognize that such risks may be present at any time before, during and after the trip. In order to be considered a Winner and partake of the enjoyment of this trip, potential Winners must be willing to accept the risk, and to confirm their acceptance to such risk in writing at Sponsors request. Tips, taxes, insurance and all other expenses associated with acceptance and use of the prize not stated herein are the sole responsibility of the Winner and his/her travel companions. All prize details are at Sponsors sole discretion.

GENERAL CONDITIONS
THIS SWEEPSTAKES IS VOID OUTSIDE THE UNITED STATES AND CANADA, AND WHERE PROHIBITED. This sweepstakes is subject to federal, state, and local laws and regulations, including tax laws. Certain restrictions may apply. Sponsor is not responsible for late, lost, stolen, mutilated, incomplete, illegible, misdirected, or postage-due mail. Entries void if the Sponsor determines the entry to not be an original, or if the entries are illegible, incomplete, damaged, irregular, altered, counterfeit, produced in error or obtained through fraud or theft. 

Sponsor reserves the right, at its sole discretion, to disqualify any individual deemed to be (a) tampering or attempting to tamper with the entry process or the operation of the Sweepstakes or Sponsors Website; or (b) acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON (S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. 

Failure by the Sponsor to enforce any provision of these Official Rules shall not constitute a waiver of that provision. In the event of a dispute as to the identity of a prize Winner based on an e-mail address, the winning entry will be declared by the authorized account holder of the e-mail address submitted at time of entry.

"Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

ENTRANT LICENSES/RELEASES  
Participants also agree (a) to be bound by these Official Rules and (b) if he/she wins that Sponsor may use each winners name, photograph, likeness, and/or voice in any publicity or advertising relating to the sweeps or future promotions without compensation or approval (except where prohibited by law). All federal, state and local taxes, fees and surcharges on prizes are the sole responsibility of the prize winners. In the event that the selected winner(s) of any prize are/is ineligible or refuses the prize, the prize will be forfeited and Sponsor, in its sole discretion, may choose whether to award the prize to another winner.

RELEASE AND LIMITATIONS OF LIABILITY
By participating in the Sweepstakes, Entrants agree to release and hold harmless the Sponsor, the Administrator, their respective parents, officers, directors, employees, agents, subsidiaries, affiliates, distributors, sales representatives, advertising and promotional agencies (collectively, the Released Parties) from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of any prize, including, but not limited to: (a) any technical errors that may prevent an Entrant from submitting an entry; (b) unauthorized human intervention in the Sweepstakes; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Sweepstakes or the processing of entries; or (f) injury, death, or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrants participation in the Sweepstakes or receipt of any prize. Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. 

Released Parties are not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to Entrant's or any other person's computer relating to or resulting from participation in this Sweepstakes or downloading any materials in this Sweepstakes. Entrant further agrees that in any cause of action, the Released Parties liability will be limited to the cost of entering and participating in the Sweepstakes, and in no event shall the Released Parties be liable for attorneys fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

DISPUTES
Except where prohibited, you agree that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Oregon. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Oregon, without giving effect to any choice of law or conflict of law rules (whether of the State of Oregon or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Oregon.
